Lighthouse on
Asset Protection.

The complete reference on asset protection, domestic and offshore, for the counsel who build the plans and defend them.

Why it matters

When a plan is tested, the answer has to be in one place.

Domestic and offshore, together

Voidable transactions, bankruptcy, exemptions, entities and trusts, read alongside the law of the Cook Islands, Nevis, Belize, Switzerland, Wyoming and Delaware, so a structure can be judged in every forum a creditor may choose.

Built for the fight, not only the design

A full Part on defense: the first thirty days, discovery and the crime-fraud exception, freezing orders and asset tracing, contempt and repatriation orders, and the trustee under pressure.

Tax and reporting in the same book

Tax neutrality, U.S. information reporting, FATCA, CRS, beneficial-ownership registers, the Corporate Transparency Act, KYC and sanctions, and expatriation, wherever they bear on the plan.

Kept current, and citable

The Editorial Board updates the text as circumstances dictate, and not less than quarterly. Every paragraph carries a permanent number, so a citation holds across updates and between print and online.

55 chapters · 7 appendices · 2,054 printed pages · 491 cases

Inside the pages

Set like the great treatises, built to be used.

The Threat Matrix

Chapter 2 rates every protective tool against six classes of creditor: contract, tort, spouse, support, sovereign and the bankruptcy trustee. Each later chapter returns to the matrix, so a planner can see at a glance where a structure holds and where it gives way.

The same discipline runs through the book: comparison tables, statutory surveys by state, drafting notes on model clauses, and a citation to the paragraph for every proposition.

Who wrote it

Written by the people who wrote the statutes.

Lighthouse on Asset Protection is prepared by the Lighthouse Editorial Board. Its Editor-in-Chief is one of the primary authors of the Cook Islands Limited Liability Companies Act and led the committee that drafted the 2015 amendments to the Nevis International Exempt Trust Ordinance.

The Board has contributed to limited-liability-company and asset-protection-trust legislation in Nevis, Belize, Wyoming, Delaware, Ohio and North Carolina, and draws on the practice of Lighthouse Trust, a multinational trust company established in 1982 and resident across nine jurisdictions.
