¶ F01
Using the Checklists and the Calendar
Purpose. This appendix collects in one place the checklists and filing calendars that appear in the chapters of this treatise. It arranges them by vehicle and by event: the international trust (¶ F10), the limited liability company (¶ F30), the foundation (¶ F50), the private trust company (¶ F60), the response to a creditor's threat (¶ F70) and a master calendar of Belize and United States filings (¶ F80). Each item restates a point made in a chapter and cites the paragraph where the point is developed. The appendix adds no rule of its own. A reader who needs the reasons for an item, the statutory text or the authorities should follow the citation.
Sources. The items are drawn principally from the formation, administration and litigation checklists in chapters 6, 7, 11 to 17, 19 to 21 and 23 to 30, from the registration and funding checklist in Appendix B and from the checklists and filings table in Appendix D (see supra ¶¶ 690.11, 790.09, 1190.09, 1290.06–1290.08, 1390.04, 1490.06–1490.07, 1590.09, 1690.08, 1790.06, 1990.08, 2090.09, 2190.11, 2390.09, 2490.09, 2590.07, 2690.07, 2790.06, 2890.03, 2990.07, 3090.05, B90.02, D90.02–D90.05). Where two chapters state the same step, the steps have been merged and both paragraphs are cited. The time limits in the calendar are taken from the tables in chapters 3, 6, 7, 12, 13, 15, 27, 28 and 30 and Appendix D (see supra Tables 3-2, 6-2, 7-2, 12-1, 13-1, 13-3, 15-2, 27-1, 28-2, 30-1, 30-2 and D-2).
Assumptions. The checklists assume the structure that the treatise treats as standard: an international trust created under Belize law, with a Belize corporate or licensed trustee and a licensed trust agent; a Belize LLC or foundation formed through a licensed registered agent; a settlor, founder and beneficiaries resident outside Belize; and, for the United States items, a settlor or beneficiary who is a United States person (see supra ¶¶ 650.04, 1940.02, 2790.06, 3090.02). A domestic trust, a structure with a Belize resident or a structure that holds Belize land requires the variations noted in the chapters cited.
Statutory deadlines and internal deadlines. The calendar states the period the statute fixes. Some model documents in the appendices set a shorter internal deadline for the same act so that the statutory period is never at risk. The model trust deed, for example, directs the trustee to apply for registration within thirty days of the first receipt of property, although section 65B(1) allows ninety (see supra ¶ B90.02; ¶¶ 660.03–660.04). A practitioner who adopts a model should diarise the internal deadline and keep the statutory one in view as the outer limit.
Fees and rates. The chapters give fees and rates as they stand in the texts consulted, and several state them as originally prescribed. Before any filing, the current fee, rate and form should be confirmed with the registered agent, the trust agent or the Commission (see supra ¶¶ 1320.05, 1990.06, 2890.03).
How to use the lists. Each list is in the order in which the steps are ordinarily taken. A step that depends on an earlier one should not be taken until the earlier step is complete and recorded. The person responsible for each step should initial and date it, and the completed list should be kept on the structure's permanent file in Belize with the documents it refers to (see supra ¶¶ 390.10, 2770.07). The annual lists should be run at a fixed date each year, with one person responsible for the whole calendar (see supra ¶ 2790.06).
