¶ D01
How to Use the Checklists
Purpose. This appendix collects in one place the filings, fees, records and deadlines that the chapters examine for the three Nevis vehicles: the international trust under the Nevis International Exempt Trust Ordinance, Cap. 7.03(N) (rev. ed. 2017) ("NIETO"), the limited liability company under the Nevis Limited Liability Company Ordinance, Cap. 7.04(N) (rev. ed. 2020, as amended) ("NLLCO"), and the multiform foundation under the Multiform Foundations Ordinance, Cap. 7.08(N) (rev. ed. 2017) ("MFO"). It is a working tool for the registered agent, the trustee, the manager and the planner. It states no rule that a chapter does not state, and each line carries the paragraph where the rule is examined.
Arrangement. Paragraphs D10 to D30 cover formation of each vehicle. Paragraph D40 covers the annual cycle and what happens when it is missed. Paragraph D50 lists the documents a Nevis service provider will ask for at onboarding. Paragraph D60 collects the information-reporting dates in the Federation and the United States. Paragraph D70 covers change events: a new trustee, protector, manager or agent, a migration, a conversion or a merger. Paragraph D80 is the master calendar, reconciled with Table 30-6 (see supra ¶ 3090).
Fees and currencies. The fees shown are those in force from April 1, 2025, under S.R.O. No. 12 of 2024 (trusts), S.R.O. No. 10 of 2024 (LLCs) and S.R.O. No. 11 of 2024 (foundations), as the chapters record them (see supra ¶¶ 570.05, 1280.02, 1880.12). The schedules state each fee in Eastern Caribbean and United States dollars. The trust schedule is shown in United States dollars only, as Table 5-3 shows it. The Eastern Caribbean dollar is pegged at EC$2.70 to US$1.00, and the schedules round. A fee schedule can change by statutory rules and orders without amendment of the Ordinance, and the agent should check the current schedule before each filing.
What the checklists do not do. The checklists do not replace the deed, operating agreement or foundation constitution, which are set out in Appendices A to C (see infra Apps. A–C). They do not state the law of any other country, except the United States reporting dates that chapter 29 examines (see supra ch. 29). Where a chapter records that a practice point is unsettled, or that the registry's practice goes beyond the Ordinance, the line says to confirm with the Registrar.
